1. About these Terms
These Terms of Service (the “Terms”) govern your use of www.acko.ca (the “Website”) and of the automated AI receptionist that may answer calls to our phone line (the “AI Receptionist”), together the “Services”. The Services are provided by Acko Earth Solutions (“AES”, “we”, “us” or “our”), 6791 267 Rd, Doig River First Nation Urban Reserve, BC V0C 2H0.
By using the Website or continuing a call with the AI Receptionist, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services and contact us by email at info@acko.ca instead.
These Terms cover the Website and the AI Receptionist only. Any work we perform for you is governed by a separate written quote, contract, master service agreement or purchase order signed by AES (a “Work Agreement”). If these Terms conflict with a Work Agreement, the Work Agreement governs.
2. Using the Website
You may use the Website to learn about AES, request a quote, contact us and apply for work. You agree not to:
• use the Services for any unlawful, fraudulent or harmful purpose;
• submit false, misleading or another person’s information;
• attempt to gain unauthorized access to, interfere with, or disrupt the Website, our systems or our service providers’ systems;
• upload viruses or other malicious code, or use bots, scrapers or other automated means to access the Website; or
• copy or use our content in a way that suggests AES endorses you or your business.
3. Information on the Website
Content on the Website, including descriptions of services, equipment, capabilities, project examples and safety statistics, is general information provided in good faith. It is not an offer, quote, warranty or professional advice, and it may change without notice. Pricing, scope, schedule and availability are confirmed only in a Work Agreement.
4. Our AI Receptionist
Calls to our phone line may be answered by an AI assistant powered by a third-party provider (currently Bland AI). By continuing a call with the AI Receptionist, you acknowledge and agree that:
• You are speaking with an AI, not a person. The AI Receptionist is an automated system and is not monitored in real time.
• Calls are recorded and transcribed. Recordings, transcripts and summaries are handled as described in our Privacy Policy. If you do not wish to be recorded, please hang up and email info@acko.ca.
• It takes messages; it does not make commitments. The AI Receptionist cannot give binding quotes or pricing, confirm schedules or crew availability, accept or change any order or contract, make hiring decisions, or speak for AES on legal, safety, environmental or regulatory matters. Nothing it says binds AES unless an authorized AES representative confirms it in writing.
• It can make mistakes. AI responses may be incomplete, inaccurate or misunderstood. Please do not rely on them for any decision; confirm important information with an AES representative.
• It is not for emergencies. Do not use the AI Receptionist to report emergencies, injuries, fires, spills or other urgent safety incidents. Call 911 or the appropriate emergency line, and contact your site supervisor directly.
• Use it respectfully. Do not use the AI Receptionist to harass, spam or place automated calls, or try to manipulate it into revealing information about AES, our staff or our clients, or into making statements or commitments. We may end calls or block numbers that misuse it.
We try to respond to messages within one business day, but we do not guarantee that any message will be received, delivered or answered by a particular time.
5. Information you send us
You are responsible for the accuracy of anything you submit through a form, by email or by phone. Submitting a quote request or job application does not create a contract or obligate AES to provide services, interview or hire you.
If you send us suggestions or ideas about our services, you agree we may use them without obligation to you. Please do not send confidential or proprietary information unless we have agreed in writing to receive it in confidence.
6. Intellectual property
The Website and its content, including text, photographs, graphics, the Acko Earth Solutions name and logo, are owned by or licensed to AES and are protected by Canadian and international law. You may view and print pages for your own reference. Any other use requires our prior written permission. Third-party names and logos shown on the Website, such as safety and prequalification programs, belong to their respective owners.
7. Third-party links and services
The Website links to third-party sites, including Facebook, Instagram and LinkedIn, and the Services rely on third-party providers. We do not control and are not responsible for third-party sites or services, and your use of them is subject to their own terms.
8. Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose or uninterrupted availability. We do not warrant that the Services will be error-free, secure or free of harmful components.
9. Limitation of liability
To the extent permitted by law, AES and its owners, directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from or related to your use of, or inability to use, the Services, including any reliance on information provided by the Website or the AI Receptionist. Our total liability for any claim relating to the Services is limited to CAD $100. Nothing in these Terms limits liability that cannot be limited under applicable law, and these limits do not apply to any Work Agreement.
10. Indemnity
You agree to indemnify and hold harmless AES and its owners, directors, employees and agents from any claims, losses and costs (including reasonable legal fees) arising from your misuse of the Services or your breach of these Terms.
11. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. You agree to the exclusive jurisdiction of the courts of British Columbia for any dispute relating to the Services, unless applicable law requires otherwise.
12. Changes and general terms
We may update these Terms or change, suspend or discontinue any part of the Services (including the AI Receptionist or its provider) at any time. The updated Terms will be posted on this page with a new “Last updated” date, and your continued use of the Services means you accept them.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and AES about the Services, separate from any Work Agreement.
